5:35 pm
president trump to testify under oath before the senate next week. he is refusing. can they force him to testify? essentially the answer is no and a way to understand it is that this is not this is solely a political process decision. and so even though the even if the senate wanted to subpoena him or to make some rules to require him to testify, they can't invoke a court's power to enforce it because the senate is in charge of its own rules, and they are the court of impeachment. they wouldn't go toe say, let's say a federal court. that would have any power to make him testify. so democrats want to try a president who has left office. donald trump is now a private citizen, and his lawyers are arguing that impeachment is unconstitutional. is it or isn't it? i think not, and it's
5:36 pm
important even in listening to lindsey graham statement is that, he says. that they're trying to impeach someone who is no longer president. and that's unconstitutional. he has been impeached, and in this case, it's important to pay attention to the difference between the impeachment that came from the house and was done while he was still president and the trial, which is happening after he has left off, so i think it is. it is constitutional, too. all right. you have i'll post. all right. so what should we expect to see next week in real trials? a real court we see witnesses testifying, we see cross examinations. we see rules of evidence. do you think we'll see any of that in this trial? it's very different as i mentioned because it is an internal legislative branch function, so even though it will be presided over by a justice, the actual house
5:37 pm
managers who are bringing the case in the article of impeachment, they're going to be like the prosecutors. and trump's defense lawyers, whoever he has when the trial starts will defend him. and if any issues of evidence come up than the presiding justice will decide upon that, but it won't be referring to anything similar to a real court of law. this is a this is part of the political branch decision whether or not in this case, trump should be barred. convicted and barred from ever holding office again. so how do you see things progressing here? what will it take to convict or acquit? well, i think that so many republicans have already indicated that they are going to acquit. even before the case even before the evidence even before the trial that, as was the case before, a lot of it is just going to be, you know, counting political alliances. if trump were to say
5:38 pm
yes to testify, which, so far you said not. i do agree that it would be more like a what one person called a dog and pony show. but here's here's why it's important to ask. because the brief filed on behalf of a former president trump denied the allegations of the articles of impeachment and so by denying them they are requiring, really the house managers to say, well, let's put you on the standard here. you under oath, say whether or not this happened. um, if it doesn't happen if trump doesn't appear, i think it's just going to appear like one more, um, example of disregard for the rule of law, which president trump former president trump is really had a lot of trouble observing the importance of the little law. okay well, one of
5:39 pm
two things will happen, will either see a conviction or an acquittal. what would either mean for donald trump? what? let's begin with what would a conviction mean for him? okay so, um so i think we will see an acquittal just because of what republicans have said, and because of the requirement of a two thirds vote for conviction, so if there is, um acquittal, then that's the end of it. if there is a conviction then because he is already out of office, then the focus would be on the parameters of disqualification from holding any future office of the united states. that phrase has never been established in any impeachment trial. it's never been. there's never been caused, too, but in this case, it is very much alive issue, and so that will be the focus of discussion, all right. so you were saying, you thinking acquittal, and in this case if he does become a queer get acquitted, then that would clear the path for him to run for public office. if he ever decides to do so again, that z.
5:40 pm
how it would work. if there is one more constitutional provision that's being talked about 14th amendment section three. but that's zentai rly, separate from the issues that are going to be considered next week. all right, well, a lot to play out in the next day in the coming days. we appreciate you helping us break some of this down. margaret russell. thanks for being with us today. it was good to have you. thank you, democrats moved to pass a coronavirus stimulus bill without any republican support. some of the things democrats want to include also a multibillion dollar libel lawsuit filed over accusations of lies about the election. pickh
